Commercial Establishments Registration (Uttar Pradesh)
Anyone
who is starting a commercial establishment or a shop in Uttar Pradesh, mandatory to file for
registration under the U.P.
Dookan Aur Vanijya Adhisthan Act 1962, within 3 months of commencement of its establishment.
Premises governed by the Act are :
- shops,
- commercial establishments,
- residential hotels,
- clubs,
- restaurants,
- eating houses,
- theaters and
- other places of public amusement or entertainment etc
except those who
falls under Factories Act 1948. As this is such a basic license, many other authorities or institutions require this as proof of a commercial business as a prerequisite.
Shop
and Establishment Act regulates the condition of work, hours of work, payment
of wages, leave, holidays enlists the right of employees and other conditions of
work of persons employed in shops, commercial establishments, establishments
for public entertainment or amusement and other establishments in an organised
sector.
This registration is compulsory for every business (whether Shop or Commercial Establishment) whose place of work is in UP except
those who falls under Factories Act 1948. The registration of shops & establishment shall be maintained in FORM “K”. Every owner shall display registration number on a plate along with letters and figures at least 5 cms high (height) and 1 cm thick (breadth) written in the white or luminous paint of any color.
The
Shop and Establishment registration is a state regulation and as a result each
state follows their separate operation.
Penalties & Interest on non-compliance
Late fee for registration & renewal of a certificate - Owner will only be able to get the registration upon payment of late fee at the rate of 12.5% of the fee for registration & renewal of a certificate.
The act provides that the punishment for an offence & the provisions have been made to that any person, guilty of an offence under the act shall be liable to fine, that may, for the first offence, extend to Rs. 100 rupees and for every succeeding offence the fine may extend to Rs. 500 rupees
